Terms & Conditions

Preamble

These General Terms and Conditions ("Terms") govern all sales made in France or abroad through the Nauti-wave website.

Contract language

These Terms are written in French. If they are translated into another language, the French version will prevail in the event of any dispute.

Website Terms of Use

SPACEFOOT SAS may update these Terms at any time, without prior notice, including to comply with laws and regulations.

When creating an account, the Customer must read and accept these Terms. Acceptance is confirmed by ticking the relevant checkbox.

The version of the Terms that applies to an order is the version in force on the date the Customer finalises ("validates") the order.

These Terms are permanently available at the bottom of the website pages.

Access and acceptance

Access to the website https://nauti-wave.co.uk/ ("Website") requires that the Customer has read and accepted these terms of use (or the version in force at the time of access). If the Customer does not accept these terms, they must not use the Website.

Some content or services may be subject to additional specific terms, which will be clearly indicated and must be accepted where applicable.

SPACEFOOT SAS may change the Website's layout, information, legal notices, services, and content at any time.

Prohibited uses

The Customer is solely responsible for any illegal or unauthorised use of the Website. In particular, the Customer must not:

  • Upload, install, or distribute viruses or any harmful programs/files.
  • Use the Website in a way that may damage, disrupt, interfere with, or cause malfunctions in computer systems.
  • Attempt to breach Website security or authentication measures, or those of any connected network.
  • Use a false identity, impersonate someone else, or mislead other Customers about the sender of a message.
  • Collect personal data from other Customers through the Website.
  • Disrupt any event, contest, promotion, or activity run by SPACEFOOT SAS through the Website.
  • Overload the Website infrastructure, or the connected systems and networks.
  • Use the Website in a manner that violates good faith, the law, public morals, or public order.

Discount codes

Discount codes are single-use, non-transferable, and subject to the conditions of the promotion or partnership under which they were issued (including validity period, minimum purchase amount, eligible products, and/or eligible audience).

SPACEFOOT SAS may cancel any discount or order in case of misuse, fraud, or non-compliance with the applicable conditions.

In such cases, SPACEFOOT SAS may take legal action and/or delete or block the Customer's account, without the Customer being entitled to compensation.

ARTICLE 1: Definitions

SPACEFOOT SAS and the Customer are each a "Party" and together the "Parties".

  • Customer: any adult natural person with legal capacity, acting as a consumer (Law no. 2014-344 of March 17, 2014), i.e., acting for purposes outside any commercial, industrial, craft, liberal, or agricultural activity.
  • Order: any purchase by the Customer of Products offered on the Website.
  • Account: the Customer's online account used to place orders.
  • Delivery: delivery of the ordered Products to the Customer, a third party chosen by the Customer, or a carrier chosen by the Customer.
  • Products: all items offered for sale on the Website.
  • Website: the website operated by SPACEFOOT SAS at https://nauti-wave.co.uk/.

ARTICLE 2: Purpose

These Terms set out the rights and obligations between SPACEFOOT SAS and the Customer who purchases Products on the Website. They cover the full sales process, including ordering, payment, delivery, warranties, and the right of withdrawal (cancellation/return).

ARTICLE 3: Orders

3.1 Language

Orders are placed through the Customer's Account on the Nauti-wave Website.

3.2 Account registration, login, and termination

To place an order, the Customer must be clearly identified by logging into their Account.

To create an account, the Customer completes the online form and provides the required information (including name, phone number, email address, billing and delivery address) and chooses a password.

The Customer then logs in using their email address and password.

Passwords are personal and confidential. The Customer is responsible for keeping their password secure. Any order placed through the Account is presumed to have been placed by the Customer.

If the Customer suspects their password has been lost or disclosed, they must change it immediately from their Account.

If the Customer forgets their password, they can request a reset using the "Forgotten password?" feature and will receive a reset email.

The Customer must promptly notify SPACEFOOT SAS of any unauthorised access or misuse of the Account. Until SPACEFOOT SAS is notified, it is not liable for misuse by third parties.

Account termination (unsubscribe)

SPACEFOOT SAS allows the Customer to close their account at any time by requesting it via the contact form: contact_form. After closing, the Customer may register again unless:

  • the Customer refuses the Website terms of use, and/or
  • there is an ongoing dispute with SPACEFOOT SAS, or a dispute concluded with recognition of fault and/or negligence by the Customer.

3.3 Steps to place an order

Products are presented on "Product" pages with photos and key technical characteristics. Product photos are for illustration and are not contractual.

Placing an order implies acceptance of the Product description and the applicable price.

The Customer selects Products by clicking "Add to Cart". At any time, the Customer may review or change the order by returning to the cart.

To finalise the order, the Customer clicks "Place order", accepts the Terms (if required), reviews the order summary, and completes payment.

The order becomes binding only once the Customer has paid in full.

After validation, Nauti-wave sends an order confirmation email to the Customer, summarising the key details (Products, price, delivery address, delivery costs).

Unless proven otherwise, SPACEFOOT SAS records are evidence of the order's content, price, and date.

To prevent fraud, SPACEFOOT SAS may request documents to verify identity, payment method authenticity, and/or address.

Any change requested after order validation requires prior written agreement by email from Nauti-wave. If accepted, changes may affect price and/or delivery terms.

SPACEFOOT SAS may refuse or delay shipment, after informing the Customer, including in particular when:

  • ordered quantities are unusually high for a consumer purchase;
  • the Customer has not fully paid a previous order or a dispute is ongoing;
  • delivery is requested to a country outside the delivery zones listed in Article 7.1.

When creating an Account, the Customer must provide a phone number to help track orders and support anti-fraud checks.

ARTICLE 4: Product availability

Product and price offers are valid while displayed on the Website, subject to available stock.

If a Product becomes unavailable (in full or in part), SPACEFOOT SAS will notify the Customer by email as soon as possible.

If a Product is unavailable after the order is validated, the Customer will be refunded all amounts paid within 14 days of the order date.

ARTICLE 5: Prices

Prices shown include applicable taxes unless otherwise stated. Prices do not include shipping, handling, packaging, insurance, or other optional services unless expressly indicated.

VAT rules:

  • European Union: prices include VAT; VAT may be removed for shipments to VAT-exempt zones, where applicable.
  • United Kingdom: prices include VAT (standard rate currently 20%).
  • Outside the EU: prices exclude VAT. Local VAT and import duties may apply on arrival, along with any customs clearance fees charged by the carrier. Duties and rules vary by country.

Before purchase, the Customer can review items, quantities, prices, availability, transport costs, fees, discounts, taxes, and the total amount during checkout.

Prices applicable are those published on the Website and are expressed in the Website's currency (EUR for https://nauti-wave.co.uk/). Some prices may fluctuate until the order is placed; once placed, the price is fixed for that order.

Invoices: Customers are entitled to receive an invoice free of charge in paper form. If the Customer prefers an electronic invoice, they may request it by emailing contact@nauti-wave.co.uk.

If taxes or mandatory contributions change, Nauti-wave will inform the Customer before the sales contract is concluded.

For comparison, Nauti-wave may display the supplier's recommended retail price alongside the sale price.

Internet access costs and telecommunications charges are the Customer's responsibility. SPACEFOOT SAS is not responsible for the quality of the Customer's internet connection.

ARTICLE 6: Payment

6.1 Amount due

The total amount due (including delivery costs) is shown when the Customer finalises the order and in the order confirmation email.

6.2 Payment methods

Several payment methods are available, depending on the billing country. All available options are displayed during checkout (step 4).

6.3 Disputes / payment refusal

If the Customer's bank refuses payment, SPACEFOOT SAS may suspend the order and delivery until full payment is received.

SPACEFOOT SAS may refuse or cancel an order if there is a payment dispute or unresolved issue related to previous orders.

In case of non-payment, all amounts owed become immediately due, and SPACEFOOT SAS may suspend or cancel ongoing orders.

The Customer confirms they have the necessary authorisation to use the chosen payment method.

6.4 Retention of title

SPACEFOOT SAS retains full ownership of Products until the Customer has paid the full price.

6.5 Refunds

6.5.1 Situations that may lead to a refund

A refund may be issued in several situations, including package loss, non-delivery, a non-conforming order, or when the Customer exercises the right of withdrawal (cancellation/return) under these Terms.

When a refund is due, SPACEFOOT SAS will process it within 14 days of the event that triggers the refund, as described in these Terms.

6.5.2 Refund method

Refunds are issued to the account holder, using the same payment method used for the order.

For partial refunds, SPACEFOOT SAS may only refund after receiving the full amounts owed for the Products kept by the Customer.

ARTICLE 7: Delivery

Delivery and returns policies are available on the Website pages: "Return & refund" and "Delivery rates and options".

7.1 Delivery area

The delivery area is listed and updated on the "Delivery rates and options" page.

Products are delivered to the address provided by the Customer during checkout and shown in the order summary. Deliveries are made to the Customer's home or the address specified by the Customer.

7.2 Delivery methods and times

Shipping times are shown on each Product page below the "Add to Cart" button and may vary by item and by selected size. The displayed shipping time updates automatically when the Customer selects a different size.

Delivery costs are paid by the Customer and are shown during checkout and in the Customer's account order summary.

The Customer can track delivery via the carrier's website.

If a parcel is returned due to the Customer not collecting it from the chosen delivery point, SPACEFOOT SAS will cancel and refund the order under Article 6.5.

7.3 Delivery costs

Deliveries are carried out by a transport service operating in the destination country.

Shipping costs are calculated after applying any commercial discounts.

All duties and taxes associated with the order are borne by Nauti-wave; the Customer should not have to pay additional fees on delivery/collection.

SPACEFOOT SAS is not responsible if non-delivery results from the Customer's failure to fulfil their obligations (e.g., wrong address, failure to collect).

Additional delivery costs

Some items may incur extra shipping costs due to weight or size. Where applicable, these are added automatically during checkout and shown at step 3 ("Delivery Method").

7.4 Delivery delay

If delivery is delayed, the Customer will be informed as soon as possible by SPACEFOOT SAS or the carrier, along with an estimated delay.

If the Customer does not receive the order more than 7 working days after the delivery date indicated by the carrier and/or SPACEFOOT SAS, the Customer may:

  • notify the professional that they are suspending payment of all or part of the price until delivery; and/or
  • formally request delivery within a reasonable additional period.

If delivery still does not occur, the Customer may terminate the contract by contacting Customer Service via the contact form. The contract is considered terminated when SPACEFOOT SAS receives the termination request, unless delivery occurs before then.

The Customer may terminate immediately if SPACEFOOT SAS refuses to deliver, if it is clear delivery will not occur, or if the agreed delivery date was an essential condition for the Customer (based on circumstances or an express request before ordering).

The Customer cannot terminate due to delay where the delay is caused by force majeure as defined under French law.

If the Customer terminates under these conditions, SPACEFOOT SAS will refund the Customer under Article 6.5.

7.5 Package loss

If a package is lost, SPACEFOOT SAS may open an investigation with postal services or the carrier.

If the package is found, it will be reshipped at SPACEFOOT SAS's expense.

If the package is not found, SPACEFOOT SAS will ask the Customer whether they prefer reshipment or a refund. If the Customer does not respond within 7 working days, the order will be refunded by default under Article 6.5.

7.6 Non-delivery

For non-delivery, the Customer should contact Nauti-wave by phone (+33 1 86 47 62 58), via the contact form, or by email (contact@nauti-wave.co.uk).

If delivery does not occur more than 7 working days after the stated delivery deadline, the Customer may request delivery within a reasonable additional period. If delivery still does not occur, the Customer may terminate the order by notifying SPACEFOOT SAS.

If the Customer does not wish to terminate, SPACEFOOT SAS will organise a second delivery. The Customer must confirm the redelivery address.

If SPACEFOOT SAS cannot contact the Customer, or delivery fails again, the order will be cancelled and refunded under Article 6.5. SPACEFOOT SAS bears any storage/return costs charged by the carrier.

For deliveries outside France, SPACEFOOT SAS will liaise with the transport company to agree on new delivery arrangements and inform the Customer. If new arrangements are impossible, the order is cancelled and refunded within 14 days under Article 6.5.

In all cases, SPACEFOOT SAS may request evidence of non-delivery (including a sworn statement) to process the request.

7.7 Non-conforming or damaged order

The seller is responsible for proper delivery until the parcel is physically delivered to the buyer (or a designated recipient), unless the buyer chose a carrier not offered by the seller.

Upon receipt, the buyer should check the condition of the products. If the parcel or products are damaged, the buyer must inform the seller as soon as possible so the seller can take action with the carrier.

The seller will cover return costs and any refund in accordance with applicable law.

These checks do not affect the buyer's rights under the legal guarantee of conformity or the right of withdrawal.

ARTICLE 8: Right of withdrawal / returns

8.1 Withdrawal period

Under Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from receipt of the order to withdraw (cancel) the purchase. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next working day.

8.2 Products eligible for withdrawal and return conditions

Returns must be sent back complete and in their original condition (including packaging, accessories, instructions), allowing resale as new, and must include proof of purchase.

Products must not show significant depreciation beyond what is necessary to check the nature, characteristics, and proper functioning of the product. Damaged, soiled, or incomplete products are not accepted.

If you test a product, you must do so within reasonable limits, similar to what would be possible in a shop. The Customer is responsible for any depreciation caused by handling beyond what is necessary.

Exceptions (non-exhaustive) where the right of withdrawal does not apply (Article L.221-28):

  • Clothing, shoes, electronic products, connected watches: no prolonged use; returns may be refused if unsealed and containing personal data/audio/video/data records and/or linked to an account, for data protection reasons.
  • Sealed hygiene products unsealed after delivery.
  • Products likely to deteriorate or expire quickly.
  • Personal Protective Equipment (PPE), due to safety requirements, even if not used.
  • Products inseparably mixed with other items after delivery, and/or returns containing items not ordered from SPACEFOOT SAS.
  • Custom-made or clearly personalised goods.
  • Goods whose price depends on financial market fluctuations outside the professional's control.

8.3 How to exercise withdrawal / returns process

The right of withdrawal can be exercised online using the <a href="https://cdn.blazimg.com/customer/EN_WITHDRAWAL_FORM.pdf" target="">withdrawal</a> form on the Website, via the contact form. Any clear, unambiguous declaration of withdrawal is also accepted.

If the Customer withdraws within the legal period, the refund includes the purchase price (including VAT) and standard outbound delivery costs. Return shipping costs remain the Customer's responsibility. Additional delivery costs for non-standard shipping are not refunded (Article L221-24).

Refund timing: within 14 days from the date SPACEFOOT SAS is informed of the withdrawal. SPACEFOOT SAS may delay the refund until it receives the returned goods or proof of shipment (whichever comes first).

If returning with a generated label, the label address may be a sorting centre; the parcel is then forwarded to the logistics warehouse for processing. If returning independently, send to:

Return costs – prepaid label

Where offered, Customers may purchase a prepaid return label on the Website. The label price is clearly shown during the label purchase process. With the Customer's consent, the label cost is deducted from any refund/credit.

If SPACEFOOT SAS does not receive the return parcel, the Customer must provide proof of delivery to SPACEFOOT SAS.

ARTICLE 9: Warranties

All orders benefit from the legal guarantee of conformity (French Consumer Code, Articles L.217-1 et seq.) and the warranty against hidden defects (French Civil Code, Articles 1641 et seq.).

A dedicated service is available via the return form under Article 8.3, with the exception that return costs may be borne by SPACEFOOT SAS in the warranty context, as applicable.

For hygiene and team safety reasons, SPACEFOOT SAS asks Customers, where possible, to return products previously washed.

9.1 Legal guarantee of conformity (summary)

SPACEFOOT SAS is liable for defects of conformity that exist at delivery and appear within two years of delivery. For goods with digital elements, specific rules apply depending on whether digital content/services are supplied continuously and for how long. The seller is also liable for issues caused by packaging, assembly/installation instructions, or installation performed under the seller's responsibility.

In case of non-conformity, the consumer may request repair or replacement, or failing that, a price reduction or contract termination, under the conditions of the Consumer Code.

9.2 Warranty against hidden defects (summary)

SPACEFOOT SAS is liable for hidden defects that make the product unfit for its intended use or significantly reduce its usefulness. The consumer must bring an action within two years from discovering the defect.

9.3 Warranty exclusions

The Customer cannot rely on legal warranties where:

  • the defect was obvious and the Customer did not make a claim under the withdrawal process;
  • damage is due to transport where the Customer chose a carrier other than the one offered by SPACEFOOT SAS;
  • damage results from abnormal use, modification/adaptation, or prolonged use by the Customer;
  • the product has been modified, adapted, or repaired without authorisation from SPACEFOOT SAS.

9.4 Warranty contact

For warranty questions, Customers can contact Customer Service via the Website contact form, by email (contact@nauti-wave.co.uk), or by phone (+33 1 86 47 62 58).

9.5 Updates (digital content/services)

Customers will be informed of necessary updates to maintain conformity of digital content/services and how to receive them, for the period reasonably expected or for the duration of supply where the contract provides continuous supply.

If the Customer does not install required updates within a reasonable time, the seller is not responsible for resulting non-conformities, provided the Customer was informed and the failure is not due to inadequate instructions.

Non-essential updates will be clearly identified. Customers will be informed in advance and may refuse or uninstall updates if they negatively affect access or use; in that case, the contract may be terminated within 30 days unless the impact is minor, or the seller offers a way to keep the service unchanged and compliant.

ARTICLE 10: Liability

The Customer is responsible for the accuracy of the information provided to SPACEFOOT SAS. SPACEFOOT SAS is not liable for issues caused by incorrect Customer details. The Customer must keep their details up to date in their account.

SPACEFOOT SAS is responsible for proper performance of its obligations relating to the order.

SPACEFOOT SAS is not liable in case of force majeure (Article 1218 of the French Civil Code) or events beyond its control (including riots, pandemics, embargoes, acts of authorities, fire, flooding, accidents, strikes, lockouts, or shortages).

Technical availability: SPACEFOOT SAS does not guarantee uninterrupted access to the Website and cannot be held liable for outages or interruptions.

ARTICLE 11: Personal data

To operate the Website and process orders, SPACEFOOT SAS processes Customer personal data (e.g., identity details, contact details, delivery address). This processing is necessary to perform the sales contract.

Information about how personal data is processed and Customer rights is available in the "Privacy notice" section.

ARTICLE 12: Intellectual property

All intellectual property rights related to the Website and/or Products (logos, trademarks, names, images, texts, videos, software, data, product pages, photos, etc.) belong to SPACEFOOT SAS and/or its licensors.

SPACEFOOT SAS is the producer of the Website databases and prohibits extraction or reuse of all or part of the Website content except as permitted by law.

Customers must not copy, reproduce, distribute, transmit, download, modify, create derivative works, sublicense, or sell Website content or Products content without prior written permission.

Private copy: Customers may keep personal, non-commercial copies of Website pages, without modification, and with all copyright notices preserved.

If a Customer wishes to reuse content, they must request permission in writing at SPACEFOOT SAS's registered office.

Customers must notify SPACEFOOT SAS if they become aware of illegal content or content infringing IP rights.

Trademarks and logos (including "Nauti-wave" and partner logos) are protected; unauthorised reproduction is prohibited.

Links: Anyone may link to the Website (including deep links), but SPACEFOOT SAS may request removal of a link at its discretion. Unauthorised reproduction may constitute infringement and lead to civil and criminal liability.

ARTICLE 13: Opposition to telemarketing

Customers may provide mobile phone numbers for order tracking and to notify Customers of unexpected events.

SPACEFOOT SAS prohibits telemarketing and does not resell contact details. Customers may register for free on the French opt-out list "Bloctel" (www.bloctel.gouv.fr).

ARTICLE 14: Product recall

SPACEFOOT SAS may implement any withdrawal/recall procedure for delivered products if requested by the manufacturer or a competent authority.

In such cases, SPACEFOOT SAS will inform Customers of the recall details (products concerned, reasons, return/restitution terms).

Where applicable, recalls under Article L.421-3 of the Consumer Code will be declared on www.rappel.conso.gouv.fr.

Customers must follow the measures requested for recalled products. Customer Service is available for questions.

ARTICLE 15: Mediation

If a dispute arises, the Customer may use a consumer mediator free of charge to try to resolve the issue amicably.

By default, SPACEFOOT SAS proposes the following mediator:

A mediator cannot examine the dispute if:

  • the Customer has not first tried to resolve the issue directly with SPACEFOOT SAS through a written complaint;
  • the request is clearly unfounded or abusive;
  • the dispute has already been examined or is being examined by another mediator or a court;
  • the Customer contacts the mediator more than one year after the written complaint to SPACEFOOT SAS;
  • the dispute falls outside the mediator's scope.

ARTICLE 16: Applicable law and jurisdiction

These Terms and all related contractual relationships are governed by French law.

In case of dispute, the Parties will first seek an amicable solution, taking each Party's interests into account, before starting legal proceedings.

If no amicable resolution is found, competent courts are those of the defendant's domicile or the place of effective delivery, subject to any mandatory jurisdiction rules.

ARTICLE 17: No waiver

If either Party does not enforce a clause at any time, this does not mean they waive their right to enforce it later.

ARTICLE 18: General provisions

If any clause (or part of a clause) is found invalid under applicable law or by a final court decision, it will be treated as unwritten, without affecting the validity of the rest of the Terms.

If either Party does not require application of a clause (temporarily or permanently), this does not constitute a waiver of that Party's rights.
